Ebay in court over bootleg prop sellers

I found this article interesting. It seems as eBay will have to start looking at sellers and what they sell a bit more closely.

Yup! I saw that article too! Should be interesting to see how this affects certain "individuals" eBay stores! This could be both a Good & a Bad thing! I know there are a few sellers like SF that I'd LOVE to see GO AWAY for the sake of the Prop Community!pee.gifoccasion14.gif  It's UNFORTUNATE that there are also a few who offer GOOD QUALITY stuff,( ie: LA & CP) on there that I'm sure either have been, or will be affected!sad.gif6.gifviolent1.gif6.gifsad.gif

I do recall a few cease and desist orders over the years being handed out to US ebay suppliers. And this new development is really not much different but just on a larger scale. The way you advertise your wears is what will get you in the most hot water. Terms such as, "film used" or just claiming to be a legit licensed product when it really is not film used or a licensed product. Also if I were to openly advertise, "Darth Vader" or any other licensed name on ebay they would have a right to prosecute me if they would so desire.   The issue here is piracy of a copyrighted name or image. So as long as it is not advertised as Vader, stormtrooper, Yoda, and so on. Or contains images owned by, or licensed by Lucas Film, there are still gray areas.  So really you could advertise,..................

For sale, Helmet liken to Darth Vader.

Armor similar to Star Wars character, Boba Fett

The key words are still there for a successful ebay search. But you are not openly claiming to offer a licensed name.

As most of you know, I do not often sell what I make on sites such as ebay. I leave that area alone mostly for fear of recasters. Not that I haven't seen my things recasted and offered on ebay. But it is just not a place that I care for all that much as a seller.
